Article 1 – Definitions

In these terms and conditions, the following definitions apply:

1. Supplementary agreement: an agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract and these are supplied by the entrepreneur or a third party based on an agreement between that third party and the entrepreneur;
2. Cooling-off period: the period within which the consumer may exercise the right of withdrawal;
3. Consumer: the natural person who does not act for purposes related to trade, business, craft or profession;
4. Day: calendar day;
5. Digital content: data produced and delivered in digital form;
6. Long-term contract: an agreement for the regular delivery of goods, services and/or digital content over a certain period;
7. Durable data carrier: any tool – including email – that enables information to be stored in a way accessible for future use and unchanged reproduction;
8. Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
9. Entrepreneur: the natural or legal person offering products, digital content and/or services at a distance to consumers;
10. Distance contract: an agreement concluded within an organised system for distance selling using one or more means of distance communication;
11. Model withdrawal form: the European model withdrawal form included in Annex I;
12. Means of distance communication: any means that can be used to conclude an agreement without physical presence of both parties.

Article 3 – Applicability

1. These terms apply to all offers and agreements.
2. Terms are made available before the agreement is concluded.
3. If electronic, they must be storable on a durable medium.
4. In case of conflict, the most favourable provision for the consumer applies.

Article 4 – The offer

1. Validity of offers will be clearly stated.
2. Offers contain a complete and accurate description.
3. Obvious errors do not bind the entrepreneur.

Article 5 – The agreement

1. The agreement is concluded upon acceptance of the offer.
2. The entrepreneur confirms receipt of acceptance.
3. Secure electronic systems are used for online orders.
4. The entrepreneur may assess payment reliability.
5. Delivery includes all required legal information.

Article 6 – Right of withdrawal

Products: 14 days withdrawal period after receipt.

Services/digital content: 14 days from contract conclusion.

Article 7 – Consumer obligations

The consumer must handle the product carefully and is liable only for depreciation caused by misuse.

Article 8 – Exercise of withdrawal

Returns must be made within 14 days. Return costs are borne by the consumer unless otherwise stated.

Article 9 – Obligations of entrepreneur

Refunds are processed within 14 days after receipt of returned goods.

Article 10 – Exclusion of withdrawal

Certain products may be excluded, such as custom-made goods, perishable goods, sealed hygiene products once opened, and digital content once performance has started with consent.

Article 11 – Price

Prices remain fixed during validity unless VAT changes apply.

Article 12 – Performance and guarantee

Products must conform to the agreement. Extra guarantees do not affect legal rights.

Article 13 – Delivery and execution

Orders are handled with care. Risk transfers upon delivery.

Article 14 – Payment

Payment must be made within 7 days unless agreed otherwise. Late payment may result in interest and collection costs.

Article 15 – Complaints

Complaints must be submitted within 8 days of receipt and will be answered within 14 days.

Article 16 – Disputes

Only Dutch law applies.

Article 17 – Additional provisions

Additional terms may not disadvantage the consumer and must be recorded in writing or on a durable medium.
